The accidental failure of suit statute, General Statutes § 52-592 (a) *fn1 affords a plaintiff a one year window of opportunity to "commence a new action . . . for the same cause" if a prior action "has failed . . . to be tried on its merits . . . for any matter of form . . . ." The question in this certified appeal is whether a disciplinary dismissal properly may be characterized as a dismissal as a "matter of form." We conclude that the answer to this question depends upon the nature and the extent of the conduct that led to the disciplinary dismissal.
